This is not really a revelation as visa fraud has been a problem for decades at US consulates around the world. But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

Dear Lawyers,
I am a registered professional civil engineer in the state of PA having an educational background of a BS from India and MS from the US in civil engineering. I got my H1B extension approved last year for its second term of three years. I have been working in the same company since my graduation and also hold an approved I-140. I am planning to visit India in March to get my visa stamping done and am concerned about the reports of valid H1B holders being returned from Newark. Do you think I should avoid Newark as the PoE?

I am planning to spend about a week or 2 in Canada, will that cause me any problems when I come back to the US? I will keep job hunting in Canada but for a job in the US as I intend to stay in the US.
No. If you however plan to be outside US for more than 6 months, then you might need to take some precautions so that your green card is not invalidated.
Am I entitled to unemployment benefits since I have a GC?
Yes.
Will my layoff create any problems for me when I want to become a citizen of the US in about 3 years?

It will not.
In general, as a green card holder, you have all rights and all responsibilities (including going to war for US in case the congress institutes draft) of a U.S. citizen, except voting rights. See the welcome letter you received with your green card.

Folks,
If an employer withdraws an approved I-140, is it enough to show a future offer of employment letter to keep your 485 alive?
My particular case: I have an approved I-140, with pending 485 (EAD/AP approved) (6 months have elapsed). I want to quit my job and go back to school this August, but want to keep 485 alive (primarily because my 6 years on H1 are up). I can easily get a letter from an employer saying that they will employ me once my GC is approved (and I can join them when GC comes through). However, my current employer says that they will withdraw 140 (routine procedure).
Questions:
1. Can I study on EAD/parolee status?
2. Do I need to inform USCIS of invoking AC21 since my employer will withdraw my 140?
3. Can I claim that I am waiting for my GC to be approved to join my future employer, and in the mean time, I am studying full time to improve my skills?
4. Should I try to maintain my H1 status during school (by working part time etc.)?
5. Does my future employer need to file an I140?
6. What should I ask my current employer to provide? Eg: copy of 140, Employment verification letter etc.
Please provide your insights. There might have been previous discussions on this topic. If so, please point me to them and my apologies in advance for re-posting.
Will appreciate any suggestions / comments. I am stuck with the dilemma of continuing to work or going back to school.

I also dint receive the FP notice for my son. When I checked the USCIS help desk and also with my attorney for my son's (5 years) FP, I was told that kids under 16 years (16 years if I correctly remember) dont need FP in 485 processing.

Hi,
Our attorney prepared and filed our (mine and my wife's) 485, EAD and AP in July 2007.
We received our EAD and AP in 2007 and they are about to expire.
We are currently planning to renew our EAD and AP and wanted to apply on our own this time.
In that context, we requested for a copy of our application forms from the attorney.
We never got to verify the filled application forms until now (the attorney sent us only the pages to be signed at the time of filing)
To our surprise, we figured out the following mistakes in the application forms:
1) My I-94# in 485 and EAD application forms was wrongly mentioned. But I had my A# correct and it matches with the one on my EAD.
2) My wife's date of last entry in US was wrongly mentioned in 485 and EAD.
3) My mother's name was misspelled (a letter was missing from her first name)
I am not sure how bad the above mistakes are.
Here are my concerns now:
1) Are I-94# and last entry date used during namecheck or any other phase during the overall process? We didnot travel outside US since we applied 485. What if we travelled (the I-94 and last entry dates would have anyways changed).
Do we need to update these details explicitly after every travel? How important is it to get these details corrected in our applications?
2) If we apply for renewal of EAD and AP with the correct details this time, is it going to be fine? Do we still need to get them fixed in our 485?
OR
Will it be a problem for renewal because the details are different from the original application?
3) What is the procedure to follow in this situation?
Any advice in this matter is greatly appreciated.

Hi ,
Does it impact I140 processing if i am outside US and worked with same employer in India ?
I have left for india assignment after concurrent filing (I 485 + I 140)
for 4 weeks and joined back in US for different assignment last year after July filings.
But i have maintained my old residence status and applied for change of address when i came on different assignment and loaction in US.
Has any one experienced similar situation ?
Does on US payroll becoming inactive for some duration ( in my case 4 weeks) make the I40 processing questionable ?
Can anyone advise ?

Now the question is,
I AM AWARE THAT SHE HAS TO GET STAMPED IF SHE TRAVELS TO INDIA, BUT what if she travels to India, when on OPT status????
