On this case, I am getting mixed anwsers
Employer's lawyer is saying that i can continue to work since have valid I-94 and they are going to appeal. Lawyer called USCIS officers and USCIS officers confirmed this ( !!!).
Second lawyer is saying that i should stop working on denied petition.
Once you apply for appeal or motion your H1B peition status changed from 'Denied' to 'Pending' and you may continue to work for employer. - this is my guess
In fact, I am planning to get advice from murhty too...
Any thoughts on this.

Same thing happened with me - My labor was approved from Phily BEC on Mar 16th 07 and my company kept saying that didn't receive anything till Apr 16th 07...
Then i was impatient and called Phily BEC and they were very nice to explain me that it can take upto 1.5 months to 2 months for my company to receive via Lawyer. In fact it may take 1 month for Phily BEC to mail - he explained.
Eventually my company received the Labor papers on May 7th 07....
Hope this story helps.

It's very painful to deal with these guys at times.
I also tried asking a finance broker about this and never heard back...
Have you tried apporaching another bank or some broker ?
(I was intrested to know if the can do a intrest only loan for 125% of current value...I would think no.....but perhaps no one has all the details ironed out yet)

I've found this site to be very helpful so far and would like to ask for some opinions on my case.
My I-485 (EB2) was submitted in 2007 and the PD is approaching, only 5 days away based on June's VB. My girlfriend is currently with F-1 visa and we are planning on getting married asap so that she can submit her 485 before my case is approved.
Here's the complete list that I can think of based on the research that I've done.
Documents that my future wife's need prepare
I-485 form
birth certificate
marriage certificate
medical exam
passport pages (I-94 card ect)
I-20 form
Two photos
Documents that I need prepare
My I-485 receipt

I am in a bit of confusion and needed some info. I had applied for I-485 during July fiasco and my spouse applied as derivative. We had applied for her H1 extension/transfer through another employer after we filed for I-485 as we did not want her to use EAD. We recently received her H-1 approval without I-94.
I am not sure at this point if she has to leave immediately to get the h1 stamp Or she can continue to stay here as her AOS is pending based on derivative status of my application.
Also will her getting approved without I-94 impact her pending AOS in anyway

If you are already in US, you don't need DS-230, you need to file I-485 instead.
I-130 is an alien relative petition filed by your spouse on your behalf. I-130 has a question if you want to "adjust status while in the U.S." or go through "consular processing at an American post abroad".
If you plan to "adjust your status while in the U.S." you use form I-485. I-130/I-485 can be filed and adjudicated concurrently.
If you want to enter the U.S. as an immigrant ("consular processing" you file form DS-230 Part I with the National Visa Center and later DS-230 Part II with a consular officer at a consulate/embassy outside of the U.S.

Hi All,
I have an approved I-140 from an employer X. I-140 was approved 2 years ago. And last year I left X company and took a full time position. Since X is my frined he did not mind leaving his company at that time.
I applied for 485 in July as a future employee for X using that approved I-140. I got EAD and AP also.
Now we got into some money issues and he wants to revoke my I-140/I485?
Can he do that?
Please advice.

As per my knowledge you do not need a transit visa for Dubai and Abu Dhabi. I traveled to India recently through Abu Dhabi and did not need one.

I think once you are in AOS pending , I-94 will not come into play.....

Also you need to prove that you have exhausted all ways to get it adjudicated.

We had a 8 hr long meeting with a lobbying firm right on the Capitol hill. The meeting progressed very well. We came out with a wealth of information. This firm seems to have the right contacts and connections. I am creating a pointwise document the people in this firm promised and were confident to achieve. You will have to open a service request (SR) with USCIS after 30 days have passed. Once you open a SR , usually service center will people will call and confirm about the current status and in about 45 days from SR open date they will try resolve the issue. If 45 days have passed, then you will have to take an infopass appointment figure out. Hope this helps!
